PhoneTell Privacy Policy
This Privacy Policy sets forth the online data collection and usage policies and practices of PhoneTell, Inc. (the “PhoneTell” or “we”) that apply to you, the user (“you”), and your use of PhoneTell’s services that are delivered via the PhoneTell site www.PhoneTell.com (the “Site”), delivered via the PhoneTell downloadable user applications (“Software”), and otherwise delivered to mobile devices and computers (collectively, the “Service”). By using or accessing the Service or any portion thereof, you accept the practices described in this Privacy Policy.
You have the option of either creating an account and becoming a “Registered User”, or merely using the Service as a visitor without providing Personal Information. You should note however, that many of the features of the Service require you to become a Registered User. We respect the privacy of all users of the Service, and unless otherwise set forth in this Privacy Policy or in the PhoneTell Terms of Use (which together form the “Agreement”); we will not release your Personal Information without your permission.

Personal Information.
“Personal Information” is unique information that identifies you, or any other person, as a distinct and identifiable individual. Personal Information includes information such as your name, email address, telephone number or mailing address. Except as provided in the Agreement, we do not sell, re-sell, or otherwise distribute Personal Information.

Sharing and Disclosure of Personal Information.
Except as otherwise described in this Privacy Policy, we will not disclose Personal Information to any third party unless requested by you, or unless we believe that disclosure is necessary to: (i) conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by PhoneTell, whether or not a response is required by applicable law; (ii) enforce the Agreement or to protect our rights; or (ii) protect the safety of members of the public and users of the Service.
We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our web servers, analyzing data, providing marketing assistance, and providing customer service. These companies and individuals will have access to your Personal Information as necessary to perform their functions, but they may not share that information with any other third party.
We reserve the right to transfer Personal Information to a successor in interest that acquires rights to that information as a result of the sale of PhoneTell or a transfer of all or substantially all of its assets to that successor in interest. -
User Account.
When you become a Registered User, you provide PhoneTell with certain Personal Information and a password chosen by you that together identifies you as a Registered User and creates your “User Account”. Your User Account also contains your personal preferences, saved items, and identifies you to PhoneTell.
- User Email Address and Mobile Phone Number.
We may use your email address or mobile phone number to send you updates, a newsletter, or news regarding the Service. Such email or text message will contain an opt-out “Do not send me notification messages” in the future. Your personal email address is not shared or displayed to other users of the Service.
- User Mobile Calls.
When you make or receive a call on your mobile device, we may search the address book of your mobile device to look for an entry that matches the telephone number of the individual whom you are calling or who is calling you. If there is a match, then the information contained in your address book related to such telephone number, such as first and/or last name and any other information (including but not limited to Personal Information) that may be stored in your address book for such telephone number may be collected by PhoneTell, stored on its servers and served up as a page on the display screen of your mobile device. We will not share the Personal Information from your address book with any third party without your permission. Each time you use the Service we may collect and store your phone number, the phone number you call, or a phone number from someone who calls you, along with the time and duration of any such call, any options you select or activate through the Service during the call, and your location when you use or activate the Service during the call (“Call Data”). We may use any Call Data we collect to operate, audit, or improve the Service. We may also use such information to distinguish you from other users, improve the relevancy and efficiency of the Service, and ultimately, to personalize the Service to you. If you decide to connect to a business or other person using the Service, we may pass along your phone number to that business or individual. The information collected by us regarding your location may include, depending on the capabilities of your device, information about your location including but not limited to geolocation, location using your mobile device’s global positioning system (if equipped), the wifi routers closest to you, cell ids of the cell towers closest to you, and the strength of your wifi or cell signal.
- Search Feature.
When you conduct a search, we may collect the search terms (including but not limited to phone numbers or website addresses) you provide, along with your IP address, unique identifiers contained in the Software or otherwise made available through the Site (e.g. cookies), the time and date of your search, and your browser configuration. We use this information to provide you with relevant and personalized search results. We may also attempt to derive your approximate location based on data received from your mobile device, your browser, and your IP address, and may use such location information to display search results tailored to your geographic location. We also use the information we collect to maintain and improve the quality, security and integrity of our services. For example we may use this information for research purposes and to improve the overall relevancy of search results. As described in the Advertising section below, we may use search query data for the purpose of personalizing the ads we display to you as part of the Service.
- Surveys and Promotions.
We may conduct surveys or sponsor promotions, sweepstakes, or contests through the Service. You may be asked to provide Personal Information including name, email address, telephone or mobile phone number, or home address, or asked to answer questions in order to participate. Furthermore, we may transfer Personal Information to certain ad partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the Personal Information and whose privacy statement will apply.
- Non-Personal Information.
“Non-Personal Information” is information that does not specifically identify you or any person as an individual, and includes, but is not limited to, such non-unique information like aggregated data from users of the Service, your web-browser type, your browsing history, or your internet service provider. Non-Personal Information is used to manage the Site, track usage and improve the Service and is not linked to any Personal Information. Non-Personal Information may be shared with third-parties to provide you more relevant services and advertisements. Your IP addresses may also be recorded for security and monitoring purposes as well as providing more relevant advertisements.
- Aggregate Data.
Non-Personal Information may be collected about your usage of the Service or retrieved from your User Account and aggregated with data from other users. For example, and without limitation, we may collect and aggregate (i) portions of the Call Data; (ii) the number of users who dialed a specific phone number; (iii) the number of users who searched for a specific website; (iv) the number of users or duration of calls made from a certain location; and (v) the number of users who clicked on a particular advertisement. Aggregated data may include information about you or your use of the Service that has Personal Information removed and is aggregated with other data. Aggregate data is collected to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users. We may provide statistical information based on this data to advertisers and other current and potential business partners.
- Advertising.
When we display advertisements to you through the Service, we may read the unique identifiers contained in the Software, or may place one or more cookies on your mobile device or computer in order to recognize that device each time we display an ad to you. We may be able to compile information over time about where you, or others who are using your computer or mobile device, saw and/or clicked on the advertisements we display. We use this information to make predictions about your characteristics, interests or preferences and to display targeted advertisements that we believe may be of interest to you. We may also associate this information with your subsequent visit, purchase or other activity on participating advertisers’ websites in order to determine the effectiveness of the advertisements. While we may use some of the information we collect in order to personalize the ads we show you, we designed our systems to select ads based only on Non-Personal Information. For example, we may select the ads we display according to certain general interest categories that we have inferred based on (a) demographic or interest data, including any you may have provided when creating an account (e.g. age, zip or postal code, gender); (b) demographic or interest data acquired from other companies; (c) general geographic location; (d) the pages you view and links you click when using the Service and PhoneTell’s advertising partners’ websites and services; (e) the search terms you enter when using the Service’s search feature; and (f) information about the users you most frequently interact with through the Service.
- Cookies.
When you use the Service, we may send one or more cookies – a small file containing a string of characters – to your mobile device or computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences and tracking user trends in order to provide more customized results about the person whom you are calling or who is calling you. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, the Service may not function properly if your cookies are disabled. Advertisements appearing on your mobile device may be delivered to you by us or by one of our advertising partners. Our advertising partners may set cookies which will allow the ad server to recognize your mobile device or computer each time an advertiser sends you an advertisement. In this way, ad servers may compile information about where you, or others who are operating your computer, saw their advertisements and determine which ads are clicked through by you. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. We do not control these third party cookies and advertisers’ use of cookies is subject to their own privacy policies, not this Privacy Policy.
- Third Party Websites, Links, and Portals
The Service provides you with content from, and links to, third party websites. The Service may also display advertisements from other companies. PhoneTell is not responsible for the privacy practices of websites or other services operated by third parties that are linked from or integrated with the Service or for the privacy practices of third party Internet advertising companies. Once you leave the Service via such a link, access a third party application (such as widgets), or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they will handle any Personal Information they collect from you.
- Children Under Age 13.
Registered Users must be aged 13 years or older. Unless we have permission from the legal guardian of a user who is under 13 years of age, we do not allow persons under age 13 to create a User Account nor do we knowingly collect or solicit Personal Information from anyone under the age of 13. In the event that we learn that information has been collected from a child under age 13 without verification of parental or guardian consent, that information will be deleted as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us.
- Changes in Our Privacy Policy.
From time to time we may make changes to this Privacy Policy. If we make changes, we will post them on our Site to make you aware of what the changes are so you will always be aware of what information we collect, how we use it, and when we may disclose it. You are bound by any minor changes to the policy when you use the Site after those changes have been posted. If, however, we are going to use your Personal Information in a manner materially different from that stated at the time of collection, we will post a notice on our Site for 30 days and/or send you a notice to the email address your User Account is registered under.
- Security.
We use commercially reasonable measures to protect your information that is stored within our database, and we restrict access to the information of our users to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. User Accounts are secured by user-created passwords. Please note that we cannot guarantee the security of User Account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time. When we display personalized ads, collect information from your use of the Service’s search feature, or otherwise collect information from your use of the Service, we take a number of steps designed to protect your privacy. For example, we store page views, clicks and search terms used for ad personalization separately from your contact information or other Personal Information.
